Data of the controller and contact with the controller

Your personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“RODO”).
The controller, i.e. the entity that determines the purposes and means of processing of your personal data, is Barbara Byczewska who conducts/businesses under the name Arteco Barbara Byczewska, Wilcza 69 / 32, 00-679 Warsaw, NIP: 5260023153, REGON: 010438473.

Processing of the data of those who contact the controller (by email, telephone, contact form, instant messaging on social networks).

When you contact me by email, phone, contact form or messenger on social media – e.g. via Messenger, WhatsApp, direct messages on Instagram, I receive your personal data directly from you and it is processed for the following purposes and on the following legal bases:

(a) to respond to your enquiries – which is my legitimate interest in accordance with the 6 (1) f) RODO;
b) to take pre-contractual action at your request, e.g. sending offers at your request – on the basis of Art. 6 (1) b) RODO;
(c) the establishment, assertion and defence of claims, which constitutes my legitimate interest in accordance with the 6 (1) f) RODO.

The provision of personal data is voluntary, but necessary for the above purposes, in particular to respond to your enquiry or to send you an offer.
Your personal data is processed for the period necessary for the above purposes or until you successfully object to the processing of your personal data. If a contract is concluded with you, the personal data collected in the course of correspondence is stored in accordance with the principles indicated in the section “Processing of personal data of customers (natural persons)”. If no contract is concluded between us, your personal data will be deleted after a maximum of 6 months from the date of contact.

Processing of personal data of customers (natural persons)

When I enter into a contract for the provision of services by me to you, when you create an account on my website, post a comment on the Website, make a purchase in my online shop or sign up for a training or similar event organised by me, I receive personal data directly from you and process it for the following purposes and on the following legal bases:

(a) conclude and perform the contract with you, on the basis of 6 (1) . b) RODO;
b) the provision of services provided by me electronically, i.e. via the Website, including: enabling the use of an online account, identifying the person registering an online account/logging in to an online account, posting comments under entries on the Website – on the basis of 6 (1) (b) RODO (processing is necessary for the performance of the contract for the provision of electronic services);
c) to keep in touch with me regarding the provision of services, the handling of possible complaints, the prevention of fraud, which is my legitimate interest according to the 6 (1) f) RODO;
d) to comply with my legal obligations relating to taxation and accounting, in particular: to issue an invoice or other accounting evidence, to keep accounts, to settle taxes, to archive data for accounting purposes, on the basis of 6 (1) . (c) RODO in connection with the provisions of tax law and the Accounting Act;
e) to establish, assert and defend claims, which is my legitimate interest in accordance with the 6 (1) . f) RODO;
f) for marketing purposes, i.e. to send you commercial information by electronic means, including a newsletter, or to make marketing communications to you by telephone, if you have given your consent, on the basis of 6 (1) (a) RODO and in accordance with 10. article of the Act on Provision of Electronic Services or 172 article of the Telecommunications Act.
The provision of personal data to the extent that it is necessary for me to fulfil my legal obligations is mandatory and arises from tax regulations and the Accounting Act. The provision of personal data for the conclusion of a contract is voluntary, but necessary for the conclusion of this contract and its performance.
The provision of otherwise personal data is voluntary and does not constitute a condition for the conclusion of a contract and its performance. Personal data shall be stored for the period of performance of the contract and thereafter until the statutory obligation to store data ceases to apply (5 years from the end of the fiscal year) and until the expiry of the limitation period for claims. Personal data processed on the basis of consent is stored until it is withdrawn.
In the case of an online account, the data processed in this account will be stored until the account is deleted (with the exception of transaction data, which I am obliged to store in accordance with statutory deadlines).
If you add content (post, comment) to the Website, your personal data will be stored for the duration of the publication of the relevant post or comments under the post, and will not be stored by me once it has been deleted.

Processing of personal data of Contractors (natural persons carrying out business activities)

If I enter into a contract with you for the provision of services to me or any other contract, I receive personal data directly from you and process it for the following purposes and on the following legal basesc
(g) conclude and perform a contract with you, on the basis of 6 (1) b) RODO;
h) to be in touch with me on an ongoing basis regarding the provision of services, the handling of possible complaints, the prevention of fraud, the maintenance of business relations, which constitutes my legitimate interest in accordance with the 6 (1) f) RODO;
i) to comply with my legal obligations in the field of taxation and accounting, in particular: bookkeeping, tax settlement, archiving of data for accounting purposes – on the basis of 6 (1) (c) RODO in connection with the provisions of tax law and the Accounting Act;
(j) the establishment, investigation and defence of claims, which constitutes my legitimate interest in accordance with 6 (1) f) RODO;
k) for marketing purposes, i.e. to send you commercial information by electronic means, including a newsletter, or to make marketing communications to you by telephone, if you have given your consent, on the basis of 6 (1) (a) RODO and in accordance with 10. article of the Act on Provision of Electronic Services or 172 article of the Telecommunications Act.

Processing of personal data of Representatives (persons representing clients or contractors)
If my client or customer (whether an individual, company or other type of entity) is represented by you or you have been appointed by him/her for ongoing contacts in connection with the conclusion and performance of the contract, I receive your personal data from the client or customer or directly from you.
I will then process your identification data (e.g. first names, surnames, name of the entity you represent or cooperate with, job title/role, scope of matters you deal with), data on the authority granted (e.g. date of authority granted, type and scope of authority granted), contact data (e.g. business telephone number, email).
I process your personal data for the following purposes and on the following legal grounds:
(a) for the purpose of entering into a contract between the contractor or client and me and its performance, in particular to verify your authority to enter into the contract on behalf of the contractor or client and to contact you as the contact person in connection with the performance of the contract – on the basis of 6 (1) f) RODO, i.e. on the basis of the legitimate interest pursued by both me and my contractor or client, which is to enable us to perform the contract efficiently on an ongoing basis and to enable us to verify your authority to enter into the contract on behalf of the contractor or client;
(b) for tax and accounting purposes, on the basis of 6 (1) . c) RODO, i.e. the processing of the data is necessary for the fulfilment of legal obligations incumbent on me under generally applicable laws, including tax law and accounting regulations;
(c) for the purpose of establishing, asserting or defending claims between the contractor or customer and me, on the basis of 6 (1) f) RODO, i.e. processing is necessary for the purposes of my legitimate interests in being able to establish, pursue or defend claims);
(d) for the purpose of establishing or maintaining a business relationship with a contractor or customer, through you, which is my legitimate interest in accordance with the 6 (1) f) RODO;
e) for marketing purposes, i.e. to send you commercial information by electronic means, including a newsletter, or to direct marketing to you by telephone, if you have given me your consent in accordance with 6 (1) (a) RODO and in accordance with 10. article of the Act on Provision of Electronic Services or 172 article of the Telecommunications Act.
If you provide me with your personal data directly, this is voluntary, but necessary for the conclusion and performance of the contract and the establishment of the business relationship. Failure to provide personal data will result in the impossibility to conclude and perform the aforementioned contract, as well as to maintain the business relationship. The provision of personal data for marketing purposes is entirely voluntary. Your personal data will be processed for the period necessary to fulfil the purposes indicated above, in particular for the duration of the business relationship and the performance of the contract concluded with my contractor or client, and will then be stored by me until the statute of limitations for claims or until the expiry of the obligation to store data under the law (e.g. tax law). Personal data processed on the basis of consent will be stored until it is withdrawn.

Processing of personal data in connection with subscription to the Newsletter

If you agree to receive the Newsletter from me by email, I will receive your personal data directly from you and process it on the basis of 6 (1) (a) RODO and in accordance with 10. article of the Act on Provision of Electronic Services or 172 article of the Telecommunications Act. The provision of personal data is voluntary. I will keep your personal data until you withdraw your consent.

Processing of personal data in social media

I maintain profiles on the following social media:

In connection with the operation of the above profiles, I acquire your personal data in connection with your subscription to my fanpages or social media channels (clicking on the ‘Like’, ‘Observe’, ‘Subscribe’, etc. icon), your publication of a comment under any of the posts posted on the fanpage or channel, and your sending me a message via the social network. I process your personal data in particular to the following extent:
(a) Your user ID (may include your first and last name);
b) your identification data and other information to the extent published by you on your own profile on the relevant social network;
(c) a profile picture (so that in some cases I can recognise your image);
d) other images (which may also depict an image) voluntarily posted by you under my posts;
e) the content of the comments and the content of the conversation with you via the social network concerned;
f) statistical data on visits to my social media profiles or channels.
Accordingly, I process your personal data for the following purposes and on the following legal bases:
a) to maintain a profile on social media, under the terms and conditions laid down by the operators of these social networks, and to communicate through it about activities, services, promotion of the various events, competitions I organise, sharing of knowledge, as well as for the purpose of building and maintaining a community and for the purpose of communication through the available functionalities of the social networks (comments, chat, messages, including event registrations), which is my legitimate interest according to the 6 (1) f) RODO;
b) to conduct analyses of the functioning, popularity, use of social media profiles, which is my legitimate interest in accordance with the 6 (1) f) RODO.
If you use the statistics function on Facebook, I and Facebook Ireland Limited act as joint controllers of the data processed for statistics purposes. The arrangements between the joint controllers, which define the responsibilities for the processing of personal data, can be found here: https://www.facebook.com/legal/terms/pa-ge_ controller_addendum.
According to them, Facebook Ireland has assumed primary responsibility under the RODO for the processing of data for statistical purposes and for meeting all relevant obligations under the RODO.
Tracking of website activity can take place regardless of whether you are logged in or registered on a social network. I would like to point out that I have no influence on the online activity tracking applied by the respective social network and cannot, for example, turn it off.
You can find detailed information on activity tracking in the privacy policies of the social network operators. As for the statistics I receive from the operators, I have limited influence over them and can only prevent their transmission to a limited extent. If you are a logged in/registered user of the respective social network, please verify your privacy settings to match your preferences.
The provision of personal data is voluntary.
Information that is contained in private messages sent to me via social networks will be stored for the duration of the response to the questions sent (for a maximum of 3 months) or until the termination of the relationship or the deletion of your user profile on the social network, whichever comes first.
In the case of information held by me as part of your shared comments, it will be available on my profile until you delete it.
Personal data collected by the social network concerned, i.e. your posting history, activity history and messaging history will be stored according to the terms and conditions of the relevant social network.
Statistical data on visitors to my social media profiles will be processed for the duration of the data’s availability on the relevant social media site in accordance with its terms and conditions.
Please note that in addition to me, the controller of your personal data is the operator of the respective social network you use and through which you visit my profile. I have limited influence on how your personal data is processed by the respective social network operator. Please additionally read the terms and conditions and privacy policy of the social network you are using and through which you visit my profile.

Processing of personal data of participants in competitions

If you are participating in a competition I am organising on my Website or social media, the rules for processing your personal data may be separately set out in the rules of such competition. If nothing else follows from these separate rules, I process your personal data, provided directly by you, for the following purposes and on the following legal bases:
a) to conduct the competition, select the winner, inform the winner of the prize, transfer the prize – on the basis of the consent referred to in the 6 (1) a) RODO;
b) to comply with my legal obligations in connection with the organisation of the competition and the awarding of the prize to the winner, if the nature of the competition and the prize so requires, on the basis of 6 (1) (c) RODO in connection with tax legislation;
(c) for the purpose of handling complaints, establishing, pursuing and defending claims – which is my legitimate interest according to the 6 (1) f) RODO.
The provision of personal data is voluntary, but necessary to take part in the competition. If the award of the prize involves the fulfilment of tax obligations, it will be mandatory for you to provide personal data.

Processing of data in connection with the sending of requests for the exercise of rights under the RODO

As you have certain rights in relation to my processing of your personal data, you may address correspondence to me regarding the exercise of these rights. In this regard, I process your identification data, contact data, and other data provided in correspondence with you or any other person who sends me a request on your behalf to exercise your rights under the RODO. If the application is not sent directly by you, but by an agent or legal representative, I shall additionally process the data concerning that agent or representative, i.e. their identification details, contact details and details of the nature of their mandate.
Applicants’ personal data are processed by me for the following purposes and on the following legal bases:
(a) for the purposes of contacting and corresponding with you regarding a request you have made for the exercise of your rights under the RODO – on the basis of 6 (1) 1(c) RODO, as the processing of personal data is necessary for the fulfilment of a legal obligation incumbent on me under the 12 paragraph 1-3 RODO;
b) for the archiving of correspondence carried out on the handling of the sent request for the exercise of rights under the RODO, for evidential purposes and to demonstrate that I have responded to the sent request in a timely manner, which is my legitimate interest according to the 6 (1) f) RODO.
The provision of personal data is necessary to fulfil the request made.
Personal data is processed for the duration of the correspondence and will then be archived for evidence purposes until the expiry of the limitation period for claims.

Recipients of personal data

Your personal data may be disclosed by me to other entities, i.e.:
a) to my subcontractors, contractors, in particular to entities providing legal, training, accounting, marketing, IT services (in most cases, these are processors with whom I have entered into contracts for the entrustment of the processing of personal data);
(b) banks or intermediary institutions for making payments in the online shop;
(c) couriers, postal services;
d) entities authorised by law;
e) when you publish content on my Website or social media profile, your personal data may also be visible to visitors to the Website or my social media profiles.

Data transfer outside the EEA

In connection with my maintenance of profiles or channels on social networks, your personal data is processed through a specific social network, the servers of which may be located in the United States or another country outside the European Economic Area (EEA). When transferring personal data outside the EEA, social network operators are required to apply appropriate safeguards, in particular the EU Standard Contractual Clauses. In such cases, you may request a copy of these relevant safeguards. More detailed information can be found in the privacy policies of the individual social networks. In connection with my use of Google Analykcs, email and potentially other service providers, your personal data may also be transferred to a third country, exclusively on the basis of the appropriate safeguards under the RODO, in particular the EU Standard Contractual Clauses. Your rights

You have the following rights in relation to my processing of your personal data:
a) access to your personal data (Article 15 RODO), including obtaining a copy of your data (Article 15(3) RODO),
b) to rectify (correct) or complete incomplete personal data (Article 16 RODO),
(c) to request the erasure of personal data in cases provided for by law (Article 17 RODO),
(d) request the restriction of the processing of personal data (Article 18 RODO),
e) to receive your data in a structured commonly used format and their portability when the processing is carried out on the basis of your consent or contract by automated means (Article 20 of the RODO),
f) to object to the processing of your personal data where it is processed for my legitimate interest, on grounds relating to your particular situation (Article 21 RODO),
(g) to withdraw the consents given at any time, without affecting the lawfulness of the processing that took place on the basis of the consents before their withdrawal.
